Plaintiff alleges negligence against defendants following multi-vehicle collision

Jesus Penaloza Herrera has filed a negligence complaint against Amber Marie Amezcua and Jose Amezcua in the Superior Court of California, County of Santa Clara. The complaint, filed on May 31, 2024, alleges that the defendants' actions on December 15, 2022, led to a serious car accident resulting in significant injuries to Herrera.

According to the court documents, Jesus Penaloza Herrera was driving northbound on California State Route 101 Freeway in Mountain View when his vehicle was struck from behind by another vehicle driven by Amber Marie Amezcua. The collision occurred as traffic slowed due to congestion. Herrera claims that Amber failed to maintain a safe following distance and speed, causing her vehicle to rear-end another car, which then collided with Herrera's vehicle. This chain reaction pushed Herrera's car into the vehicle ahead of him.

The complaint further states that the vehicle driven by Amber was owned by Jose Amezcua. It is alleged that Jose negligently entrusted his vehicle to Amber despite knowing or having reason to know she was unfit to drive safely. Additionally, the complaint names Does 1 through 20 as co-defendants whose identities are currently unknown but who are believed to be legally responsible for the incident.

Herrera asserts that both Amber and Jose violated several provisions of the California Vehicle Code, including §21703 and §22350. These statutes mandate maintaining a reasonable and prudent following distance and speed on highways. By failing to adhere to these laws, the defendants allegedly caused a multi-vehicle collision resulting in severe injuries to Herrera.

The plaintiff is seeking various forms of relief from the court. These include special damages for medical expenses and other financial losses incurred due to the accident, general damages for pain and suffering, prejudgment interest as allowed by law, and reimbursement for legal costs associated with filing this lawsuit.

Representing Jesus Penaloza Herrera is attorney Oshin Baghram from JT Legal Group APC. The case has been assigned Case No. 24CV440284 and will be presided over by Judge L. Ayala in the Superior Court of California for Santa Clara County.
