Patient Sues Doctor Over Alleged Medical Malpractice During Biopsy

A medical malpractice lawsuit has been filed against a doctor, alleging severe negligence during a surgical procedure that resulted in significant personal injuries. On July 11, 2024, John and Marni Balletto filed a complaint in the Superior Court of California, County of Santa Clara, against Dr. Richard Nguyen and unnamed defendants.

According to the complaint, John Balletto was under the care of Dr. Richard Nguyen and other medical staff when he underwent a temporal artery biopsy on September 21, 2023. The plaintiffs allege that Dr. Nguyen and his team failed to meet the standard of care before, during, and after the procedure. As a result of these alleged failures, John Balletto suffered severe personal injuries. The complaint states that "Defendants violated the standard of care in the pre-operation care, the procedure itself, and post-operation care."

The plaintiffs argue that Dr. Nguyen and his team owed them a duty of care which they breached through their negligent actions. This breach led to both physical and emotional harm for John Balletto. Furthermore, Marni Balletto claims loss of consortium due to her husband's injuries. The complaint reads: "As a direct and proximate result of the actions and inactions of Defendants... Plaintiffs have sustained both past and future special and general damages."

The Ballettos are seeking economic damages for medical expenses incurred as well as non-economic damages for pain and suffering. They have requested judgment from the court for all allowable damages to be determined at trial.

Representing the plaintiffs are attorneys Michael D. Green and Brian G. Lance from Abbey, Weitzenberg, Warren & Emery P.C., while Judge C. Roman will be presiding over the case identified as Case No. 24CV442943.
