Jeremy Witt, a former employee of a global technology company, has filed a lawsuit alleging significant labor violations. On April 24, 2025, Witt submitted his complaint to the Superior Court of California in Santa Clara County against ePlus Inc., accusing the company of various labor code violations and wrongful termination.
Witt's complaint outlines several grievances against ePlus Inc., where he worked as a Principal Solutions Architect from April 2022 until June 2023. He claims that he was misclassified as an exempt employee, which deprived him of rightful overtime pay. According to Witt, he consistently worked over 60 hours per week but was compensated only for regular hours without any overtime benefits. The lawsuit alleges that this misclassification violated California Labor Codes §§ 510, 1194, and others related to overtime wages. "Plaintiff never made more than 50% of his total gross income on sales commissions," the complaint states, emphasizing his non-exempt status due to insufficient commission earnings.
The lawsuit further accuses ePlus Inc. of failing to reimburse business expenses and engaging in unlawful business practices under California Business & Professions Code §§ 17200 et seq. Witt claims that during his tenure at ePlus, he incurred various business-related expenses necessary for his job duties but was not reimbursed as required by law. Additionally, Witt raises concerns about whistleblower retaliation after he reported fraudulent activities within the company's security services team. His efforts to address these issues internally allegedly led to constructive discharge when faced with an ultimatum to resign or be terminated.
In seeking redress from the court, Witt demands compensation for unpaid wages amounting to approximately $188,390 in unpaid overtime alone. He also seeks interest on lost wages totaling $26,000 and waiting time penalties estimated at $45,515 due to delayed wage payments upon separation from employment. Furthermore, Witt requests reimbursement for business expenses around $30,000 along with punitive damages for retaliatory actions taken by ePlus Inc.
