Sacramento Resident Sues Dog Owner for Personal Injuries Following Vicious Attack

A Sacramento resident has filed a lawsuit seeking damages for injuries sustained from a dog attack. The complaint, filed by Karanak Phaisonkham in the Superior Court of California, County of Sacramento on August 15, 2024, names Mai Xiong and other unidentified individuals as defendants.

According to the court documents, Karanak Phaisonkham alleges that on December 10, 2023, he was lawfully present at a property located at 1420 Nogales Street in Sacramento when he was attacked by a German shepherd/Malinois mix dog owned and controlled by Mai Xiong. The plaintiff claims that the defendants were aware or should have been aware of the dog's vicious disposition and dangerous propensities prior to the incident. "Defendants negligently hired, trained, and/or supervised the other defendants in such a fashion as to cause and/or contribute to the occurrence of the incident described herein," states the complaint.

The plaintiff asserts that each defendant is legally responsible for his injuries due to their ownership and control over both the dog and the property where the attack occurred. The complaint further alleges that all defendants were acting within their capacity as agents or employees of one another during this period. "Plaintiff is informed and believes and thereon alleges that at all times herein mentioned each of the defendants were the agent(s) and employee(s) of each of the remaining defendants," reads another section of the document.

Phaisonkham's lawsuit seeks both economic and non-economic damages. Economic damages include past and future medical expenses, loss of income or earning capacity, loss of ability to provide household services, incidental costs, consequential damages, property damage, and loss of use. Non-economic damages encompass physical and mental suffering, loss of enjoyment of life, physical impairment, inconvenience, anxiety, and emotional distress. The plaintiff also requests prejudgment interest where applicable by law.
