Tenant Sues Property Management Company Over Negligence Leading to Injury

A tenant in San Jose is taking legal action against her property management company and the building's owner after a serious injury. On August 22, 2024, Dana Hassan filed a complaint in the Superior Court of California for the County of Santa Clara against Tilden Park Crossing LLC and Greystar California, Inc., alleging negligence and premises liability.

The case revolves around an incident that occurred on August 30, 2022, when Hassan was struck by a falling window blinds rod while she was sitting on her couch at her apartment located at 868 S. 5th Street, San Jose, CA. According to the complaint, Hassan sustained substantial injuries to her head and eyes due to this incident. The plaintiff claims that both Tilden Park Crossing LLC, which owns the property, and Greystar California Inc., responsible for managing it, failed in their duty to maintain a safe living environment.

Hassan’s complaint outlines that she had been residing at the apartment since November 2021 under a lease agreement managed by Greystar. She alleges that both defendants were negligent in maintaining the premises safely. "Defendants owed a duty of care to all tenants...to own, control, supervise, manage, design, maintain, and operate the PREMISES in a reasonable manner," reads the filing. The plaintiff argues that the dangerous condition of the premises was known or should have been known by the defendants but was not addressed or adequately warned about.

As a result of this alleged negligence, Hassan states she has suffered significant physical injuries and emotional distress. She has incurred medical expenses for treatments from various healthcare professionals and anticipates further medical costs in the future. The lawsuit seeks general damages according to proof presented during trial, special damages including medical expenses already incurred and anticipated future costs, pre-judgment interest on these amounts, statutory damages as allowed by law, interest until judgment is entered, court costs incurred during litigation, and any other relief deemed just by the court.
