Woman Sues Neighbors Over Dog Attack Leading to Severe Injuries

A woman has filed a lawsuit against her neighbors after being attacked by their dogs, alleging severe injuries and negligence. Belinda Rianda, represented by the Tiemann Law Firm, filed the complaint in the Superior Court of California, County of Sacramento on August 22, 2024, naming Tina Mack, Pamela Price, Daniel Mack, and unnamed defendants as responsible parties.

According to the court documents, Rianda claims that on August 30, 2022, she was viciously attacked by large adult dogs owned or kept by the defendants. The plaintiff asserts that these dogs had a known vicious nature and propensity for violence. On the day of the incident, the dogs were reportedly unleashed and subsequently attacked Rianda's legs, arms, and back. As a result of this attack, Rianda alleges she sustained significant injuries to her body and nervous system causing ongoing physical and mental suffering.

Rianda's complaint includes three causes of action: strict liability, negligence, and exemplary damages. In her first cause of action under strict liability, Rianda contends that the defendants are directly responsible for her injuries due to their ownership or control over the dangerous animals. She states that these injuries have led to permanent disability and seeks general damages exceeding $25,000.

The second cause of action is based on negligence. Rianda argues that the defendants acted negligently by allowing their dangerous dogs to roam without proper restraint. This lack of control directly resulted in her being attacked and injured. She claims that this negligent behavior caused her substantial harm requiring medical treatment which will continue into the future.

In her third cause of action for exemplary damages, Rianda alleges that despite knowing about their dogs' vicious tendencies from prior incidents or observations, the defendants failed to take necessary precautions to prevent such attacks. She believes this gross neglect warrants punitive damages to deter similar conduct in the future.

Rianda is seeking various forms of relief from the court including general damages within its jurisdictional limits for pain and suffering; compensation for medical expenses incurred and anticipated; pre-judgment interest as per California Civil Code Section 3291; exemplary damages determined by the court; costs associated with filing this suit; and any additional relief deemed appropriate by the court.
