A San Francisco resident has taken legal action against the City and County of San Francisco, alleging negligence in maintaining public property that led to severe injuries. On August 29, 2024, Alyonik Hrushow filed a complaint in the Superior Court of California, County of San Francisco, accusing the City of San Francisco, County of San Francisco, and San Francisco Public Works of failing to address a dangerous condition on public property.
According to the complaint, Hrushow claims that on April 28, 2024, she was walking on the sidewalk at the northwest corner of 4th Street and Mission Street when she tripped over an exposed tree stump. The fall resulted in serious injuries and damages. Hrushow alleges that the defendants were negligent in their ownership, maintenance, and control of the area where she fell. She asserts that they failed to maintain the sidewalk and tree stump in a reasonably safe condition and did not warn pedestrians about the potential hazard.
Hrushow's complaint details her belief that all named defendants were aware or should have been aware of the dangerous condition posed by the exposed tree stump. Despite this knowledge, they allegedly did nothing to mitigate the risk or inform the public about it. "Defendants negligently failed to maintain the sidewalk area and tree stump in a reasonably safe condition," reads part of Hrushow's filing. Furthermore, she claims that their negligence directly caused her physical pain and emotional suffering.
The plaintiff is seeking general and special damages for her injuries, including medical expenses incurred and future medical costs expected as a result of her fall. Additionally, Hrushow is asking for reimbursement for court costs and any other relief deemed appropriate by the court.
