San Francisco Woman Sues Major Grocery Chain Over Negligence Leading To Severe Injuries

A San Francisco woman has filed a lawsuit against a major grocery chain, alleging negligence and unsafe conditions led to her severe injuries. Adela Villamar lodged the complaint in the Superior Court of California, County of San Francisco, on September 10, 2024, targeting Albertsons Safeway LLC and its affiliated entities.

According to the court documents, Villamar claims that on September 19, 2022, she suffered significant injuries after falling due to hazardous conditions at a Safeway store located at 3350 Mission St., San Francisco. The plaintiff asserts that the defendants failed in their duty to maintain a safe environment for customers. "Defendants negligently and carelessly owned, leased, rented, occupied, possessed, designed, constructed, developed, landscaped, operated, inspected, repaired, maintained, modified, managed, controlled and/or supervised the subject premises," states the complaint.

Villamar alleges that despite being aware of the dangerous condition or having enough time to discover it through reasonable care and inspection processes, the defendants did not take appropriate measures to warn customers or rectify the hazard. This negligence directly resulted in her fall and subsequent injuries. The plaintiff further contends that these injuries have caused her ongoing physical and mental pain and suffering and may lead to permanent disability.

The lawsuit also accuses Albertsons Safeway LLC of negligent hiring practices. Villamar argues that the company failed to properly train or supervise its employees regarding maintaining safe premises. She claims this oversight contributed significantly to her accident. "Defendants knew or should have known that their employees would not clean in an appropriate manner which would lead to a risk of danger," reads another section of the complaint.

Villamar is seeking both economic and non-economic damages from the court. These include compensation for lost wages and employee benefits due to her inability to work following the incident. She is also asking for reimbursement of medical expenses incurred from treating her injuries as well as future medical costs related to ongoing treatment. Additionally, she seeks damages for physical pain and suffering along with loss of enjoyment of life due to her sustained injuries.

Represented by attorney Alan B. Blanco from Rafi & Associates P.C., Villamar demands a jury trial for this case identified as CGC-24-617944. The presiding judge has yet to be named.
