Plaintiff Municipal Corporation Alleges Negligence Against Defendant Over Vehicle Collision

The City and County of San Francisco has taken legal action against an individual, seeking reimbursement for workers' compensation benefits following a vehicular incident. The complaint was filed by the City Attorney's Office in the Superior Court of California, County of San Francisco, on September 26, 2024, naming Keithen Johnson as the defendant.

According to the complaint, the City and County of San Francisco, a municipal corporation organized under California law, alleges that its employee, Bernie Hession, was involved in a vehicle collision on October 7, 2024. The incident occurred while Hession was performing his assigned duties within the city limits. The plaintiff claims that Johnson and other unnamed defendants were responsible for negligently managing and operating their vehicle, leading to the collision with Hession's vehicle.

The complaint details that due to this alleged negligence by Johnson and others involved, Hession sustained bodily injuries. Consequently, the City and County of San Francisco have been compelled to pay workers' compensation benefits exceeding the jurisdictional limit of limited court jurisdiction. The plaintiff anticipates further financial obligations related to disability payments and medical care for Hession in the future.

In pursuit of justice and reimbursement, the City seeks several forms of relief from the court. These include repayment for all benefits paid to date and any additional expenses incurred until judgment satisfaction. Furthermore, they request prejudgment interest at the legal rate from each payment date made by them, coverage for attorney fees, costs associated with the lawsuit itself, and any other relief deemed appropriate by the court.
