Plaintiff alleges car manufacturer breached warranties over defective Jeep Cherokee

Greg Michael Semenza has filed a lawsuit against FCA US, LLC, alleging multiple breaches of warranty and violations of consumer protection laws related to a defective vehicle. The complaint was lodged on October 7, 2024, in the Superior Court of California, County of Santa Clara.

According to the complaint, Greg Michael Semenza purchased a new 2023 Jeep Cherokee from FCA US, LLC. He claims that the vehicle was delivered with significant defects that rendered it unsafe and unreliable. Despite numerous attempts to have the vehicle repaired under warranty, Semenza alleges that FCA failed to fix the issues adequately. The lawsuit outlines three primary causes of action: breach of implied warranty, breach of express warranty, and violation of the Song Beverly Consumer Warranty Act.

Semenza's complaint details how FCA provided an express written warranty for the Jeep Cherokee but failed to honor it when defects arose. "The VEHICLE contained multiple manufacturer defects," states the complaint, adding that these issues were not due to any misuse or modifications by Semenza. The plaintiff asserts that these failures breached both implied and express warranties as the vehicle was neither merchantable nor fit for its intended use.

In addition to breach of warranty claims, Semenza accuses FCA of violating the Song Beverly Consumer Warranty Act. This California law mandates manufacturers either replace defective goods or reimburse buyers if they cannot repair them after a reasonable number of attempts. The complaint alleges that FCA did not comply with this requirement despite repeated repair efforts.

Semenza is seeking several forms of relief from the court. These include reimbursement for financing and owning costs associated with the vehicle, rescission of the purchase agreement, restitution damages, and attorney's fees. Additionally, he seeks incidental and consequential damages along with civil penalties as allowed under Civil Code Section 1794.
