Plaintiff Alleges Former Employer TPX Communications Co., U.S Telepacific Corp Violated Wage Laws

Maria Gonzales, a former employee, has filed a class action lawsuit against her previous employers, TPX Communications Co. and U.S. Telepacific Corp., alleging numerous violations of California labor laws. The complaint was submitted on October 30, 2024, in the Superior Court of California, County of Santa Clara. Gonzales accuses the defendants of failing to pay proper wages and overtime, not providing meal and rest breaks, and other employment law infractions.

Gonzales worked for the defendants as an hourly-paid, non-exempt employee from approximately 2003 until September 2024. During her tenure, she claims that TPX Communications Co. and U.S. Telepacific Corp. consistently violated several provisions of the California Labor Code by not compensating employees for all hours worked, including minimum wage and overtime. The complaint also alleges that employees were not provided with legally required meal periods or rest breaks and were not paid their final wages promptly upon termination.

The lawsuit outlines multiple causes of action against the defendants: failure to pay minimum and straight time wages; failure to pay overtime wages; failure to provide meal periods; failure to authorize rest periods; failure to timely pay final wages at termination; failure to provide accurate itemized wage statements; failure to indemnify employees for expenditures; failure to produce requested employment records; and engaging in unfair business practices under California Business & Professions Code §§ 17200 et seq.

Gonzales is seeking class certification for these claims on behalf of herself and other similarly situated current and former employees who have worked for the defendants in California during the relevant statutory period. She requests various forms of relief from the court, including unpaid wages with interest, statutory penalties, liquidated damages, restitution under unfair competition laws, injunctive relief to prevent further violations by the defendants, attorneys' fees, costs of suit incurred herein pursuant to applicable sections of the California Labor Code and Code of Civil Procedure § 1021.5.
