A former employee has filed a class-action lawsuit against a health services company, alleging multiple labor law violations. The complaint was submitted by Lonnie Wong on November 20, 2024, in the Superior Court of California, County of Santa Clara, targeting Ro Health, LLC. Wong claims that the company failed to comply with several provisions of the California Labor Code and engaged in unfair business practices.
The lawsuit accuses Ro Health, LLC of numerous labor violations including failure to pay minimum and overtime wages, failure to provide required meal and rest periods, and failure to issue accurate itemized wage statements. According to Wong's allegations, these actions violate sections of the California Labor Code such as §§ 1194, 1197 & 1197.1 for minimum wages; § 510 for overtime wages; §§ 226.7 & 512 regarding meal and rest periods; § 226 for itemized wage statements; and § 2802 concerning reimbursement for required expenses. Additionally, Wong alleges wrongful termination in violation of public policy and discrimination under FEHA.
Wong's employment with Ro Health spanned from April to September 2024. During this period, she was classified as a non-exempt employee entitled to hourly wages along with legally mandated breaks and overtime compensation. The complaint highlights systemic issues within Ro Health’s operations where employees were allegedly required to work off-the-clock during breaks without proper compensation or recording of time worked. It further claims that employees were subjected to mandatory COVID-19 screenings without being compensated for this time.
The plaintiff seeks an injunction against Ro Health’s alleged unlawful practices and demands restitution for unpaid wages along with other damages including penalties under various labor codes. The lawsuit aims to represent all similarly situated current and former employees in California who were classified as non-exempt over the past four years.
