Plaintiffs Allege Negligence Against Residential Care Facility Over Mother's Death

A lawsuit has been filed against a residential care facility, accusing it of negligence leading to the wrongful death of an elderly resident. On November 26, 2024, Jaime Alfaro and Mario Alfaro submitted a complaint in the Superior Court of California, County of Sacramento, targeting Fair Oaks Estate, Inc., for their alleged failure to provide adequate care for their mother, Ruth Alfaro.

Jaime and Mario Alfaro claim that Fair Oaks Estate, a Residential Care Facility for the Elderly located in Carmichael, California, failed to meet its obligations under state regulations and contractual agreements. They allege that the facility's neglect resulted in their mother's suffering from a Stage 3 pressure injury, severe sepsis, fractured ribs, and ultimately her death on June 9, 2024. The plaintiffs assert that Fair Oaks Estate did not provide continuous care and supervision or notify relevant parties about changes in Ruth Alfaro's health condition as required by law. "The failure of the FACILITY to assess, identify, document and report Ms. ALFARO’s pressure injury was in violation of her care plan," states the complaint.

The plaintiffs accuse Fair Oaks Estate of violating several sections of Title 22 of the California Code of Regulations (C.C.R.) related to elder care facilities. They argue that the facility neglected its duty to observe residents for changes in physical and mental conditions and failed to document these changes or inform physicians when necessary. The complaint highlights specific regulatory breaches such as failing to perform ongoing re-appraisals of Ruth Alfaro's condition and not developing a plan to address her unmet needs. These failures allegedly led to prolonged suffering for Ruth Alfaro due to inadequate staffing and poor hygiene practices at the facility.

Jaime and Mario Alfaro are seeking general damages according to proof at trial, special damages also according to proof, costs of suit, and any other relief deemed just by the court. They emphasize that their mother's decline was preventable had Fair Oaks Estate adhered to applicable laws and standards governing residential care facilities.
