A former Chief Information Officer has filed a lawsuit against his previous employer, alleging wrongful termination and breach of contract. On November 25, 2024, Gary Roberts filed a complaint in the Superior Court of California, County of Santa Clara, against Cerberus Sentinel, also known as CISO Global.
Gary Roberts claims that he was wrongfully terminated by Cerberus Sentinel on October 31, 2023. According to the complaint filed by his attorney Dylan Hackett from The Hackett Law Firm, Roberts was hired in late 2022 with promises of a salary increase and stock options that were never fulfilled. Despite assurances from the company's COO and CFO that his salary would rise to $330,000 contingent upon securing a $50 million investment by December 2022, this did not materialize due to internal conflicts and failed investments. The plaintiff alleges that these failures led to a toxic work environment and ultimately his termination without cause. He believes the termination was motivated by perceived loyalty to the company’s Latin American team and as a threat to CEO David Jemmett's position.
Roberts' complaint includes three causes of action: wrongful termination in violation of public policy, constructive discharge due to intolerable working conditions, and breach of contract for unfulfilled salary increases and stock options. He argues that his dismissal violated California's public policy against terminating employees for opposing discrimination or associating with protected groups. Furthermore, he claims that Cerberus Sentinel created an adverse environment intending to force him out without resignation formally.
The lawsuit seeks compensatory damages for lost wages, benefits, emotional distress, and punitive damages aimed at deterring similar conduct by Cerberus Sentinel in the future. Additionally, Roberts is asking for attorneys' fees and costs incurred during the litigation process.
