Former Employee Alleges Wage Violations Against Healthcare Management Firm

A former employee has filed a class action lawsuit against a healthcare management organization, alleging widespread labor violations. On December 6, 2024, Lily Gotishan filed the complaint in the Superior Court of California, County of Sacramento, accusing Retina Sacramento MSO, LLC of numerous breaches of California labor laws.

Lily Gotishan, who worked as a Revenue Clerk from August 2022 to April 2024, claims that Retina Sacramento MSO failed to pay minimum and overtime wages, neglected to provide meal and rest breaks, and did not reimburse necessary business expenses. The lawsuit outlines several alleged violations of the California Labor Code, including sections related to minimum wage (1194, 1197), unpaid overtime (510), meal and rest break violations (226.7), untimely payment of wages (204), inaccurate wage statements (226(a)), untimely final wages upon termination (201-203), and failure to reimburse business expenses (2800-2802). The plaintiff argues that these practices were part of a systematic pattern of wage abuse affecting all hourly-paid or non-exempt employees within the company.

Gotishan's legal team asserts that Retina Sacramento MSO knowingly and willfully violated labor laws to boost profits at the expense of its employees. The complaint alleges that employees were required to work off-the-clock without compensation and were denied legally mandated breaks. Furthermore, it accuses the company of failing to issue accurate wage statements and not paying due wages promptly during employment or upon termination.

The lawsuit seeks various forms of relief for Gotishan and other similarly situated employees. These include unpaid wages with interest, statutory penalties for each violation under applicable sections of the California Labor Code, liquidated damages for minimum wage violations, waiting time penalties for late final payments upon termination, reimbursement for unreimbursed business expenses with interest, attorney’s fees and costs incurred in pursuing this action. Additionally, Gotishan requests injunctive relief to prevent further violations by the defendants.
