A California resident has taken legal action against a major automobile manufacturer, alleging multiple breaches of warranty related to a recently purchased vehicle. Akmal Babrakzai filed the complaint in the Superior Court of California for the County of Sacramento on December 4, 2024, targeting Hyundai Motor America as the defendant.
The case revolves around Babrakzai's purchase of a 2023 Hyundai Tucson on February 8, 2023. The plaintiff claims that despite an express written warranty provided by Hyundai Motor America, the vehicle developed numerous defects during the warranty period. These defects allegedly include issues with the body system, powertrain system, safety system, electrical system, braking system, and noise system. Babrakzai asserts that these defects substantially impair the use, safety, and value of the vehicle. According to the complaint, Hyundai Motor America failed to repair or service these defects within a reasonable number of attempts or time frame as mandated by law.
Babrakzai's lawsuit accuses Hyundai Motor America of violating several subdivisions of California Civil Code Section 1793.2 and breaching both express and implied warranties under California law. Specifically, Babrakzai alleges that Hyundai failed to replace or refund the defective vehicle as required when repairs could not be completed satisfactorily after multiple attempts. Furthermore, it is claimed that Hyundai did not provide adequate service literature and replacement parts necessary for repairs during the warranty period.
The plaintiff seeks various forms of relief from the court including actual damages exceeding $25,000, restitution for breach of warranty terms, civil penalties amounting to twice the actual damages due to willful non-compliance by Hyundai Motor America with statutory obligations under California Civil Code section 1794(c), consequential and incidental damages resulting from said breaches; along with attorney fees and other costs associated with this litigation.
