Ferdinand Cahayag filed the complaint in the Superior Court of California, County of San Francisco, on December 2, 2024, targeting Casa Flynn LLC and other associated defendants.
Ferdinand Cahayag's lawsuit stems from an incident on December 27, 2022, when he was performing an internet installation at 35 Casa Way in San Francisco. As an employee of Comcast Corporation, Cahayag accessed the building to work on a metal distribution unit (MDU) box. The MDU box was reportedly wired shut and required him to cut through these wires to complete his task. Tragically, as he opened the box to reconfigure the splitters for balancing the signal, it detached from the wall without warning and struck him. This resulted in severe injuries including a traumatic brain injury and spinal damage.
The complaint alleges that Casa Flynn LLC and its associated entities—55 Casa Way Owner LP, DRKK Limited Partnership, and 35 Casa Way LLC—were negligent in their duties by failing to ensure that the MDU box was securely attached to the wall. It is claimed that these defendants had modified or repaired the MDU box in such a way that it was unsafe but did not provide any warnings about its condition. The lawsuit accuses them of negligence under premises liability laws as well as general negligence for failing to maintain safe conditions at their property.
Cahayag argues that these actions violated specific sections of the San Francisco Building Code concerning unsafe buildings and structures. He asserts that this violation constitutes negligence per se under California law because it directly led to his injuries—a situation that such regulations are designed to prevent. The plaintiff seeks compensation for economic damages related to medical expenses and loss of earnings due to his inability to work post-incident. Additionally, he seeks non-economic damages for pain and suffering caused by his injuries.
