Former Employee Alleges Unpaid Wages and Retaliation Against Industrial Control Systems Integrator

A former employee is taking legal action against his previous employer, alleging multiple violations of labor laws and wrongful termination. Dominic Lombardo filed a complaint on December 16, 2024, in the Superior Court of California, County of Sacramento, against Performance Automation Company, Inc.

The case unfolds with Lombardo accusing the company of failing to reimburse him for business expenses, including mileage for using his personal vehicle and phone for work purposes. Lombardo was employed as a Controls Engineer from September 24 to November 6, 2024. He claims that during this period, he drove approximately 3,000 miles for work-related duties but was inadequately compensated through a mere automobile stipend and gas card. His email to Vice President Richard Allbritton on November 4, requesting fair reimbursement in line with IRS mileage rates as mandated by California Labor Code §2802, allegedly led to his abrupt termination two days later without explanation.

Lombardo further accuses the company of failing to pay minimum wages and overtime wages as required by law. He asserts that he worked more than eight hours daily and over forty hours weekly without receiving appropriate compensation. The company reportedly had a policy of not paying employees for drive time unless it exceeded 200 miles per day. Moreover, Lombardo alleges that the wage statements provided were inaccurate and failed to reflect actual hours worked or correct wage rates.

The plaintiff seeks damages for unpaid wages and penalties under various sections of the California Labor Code. Additionally, he demands punitive damages for emotional distress caused by alleged retaliatory actions following his complaint about expense reimbursements. Lombardo's lawsuit also requests injunctive relief to prevent future violations by the defendant.
