A slip in a hotel hot tub has led to a significant legal battle, as a woman alleges negligence against multiple corporations responsible for the hotel's maintenance and operations. Kristine Rowan filed a complaint on December 18, 2024, in the Superior Court of California, County of San Francisco, accusing Kyo-Ya Hotels & Resorts, LP; Marriott International, Inc.; and Hill’s Pool Service, Inc. of negligence and premises liability.

The incident that prompted this lawsuit occurred on December 25, 2022. Kristine Rowan was an overnight guest at The Palace Hotel in San Francisco when she slipped in the indoor hot tub due to what she claims were hazardous conditions. According to the complaint, these conditions included inadequate lighting and insufficient safety measures that failed to meet California's legal standards for pool safety. The plaintiff argues that the defendants were negligent in their responsibilities concerning the design, maintenance, and supervision of the hotel’s facilities.

Rowan's lawsuit highlights several alleged failures by the defendants. She claims they were aware or should have been aware of the dangerous conditions but did not take necessary actions to rectify them or warn guests adequately. "Defendants negligently... owned, leased... controlled... supervised the subject premises," states Rowan's complaint. She also notes that following her accident, an inspection by San Francisco’s Department of Public Health found issues with the pool lighting which led to temporary closure until corrections were made.

The plaintiff is seeking damages for personal injuries sustained during her fall, which include head trauma and other physical injuries leading to ongoing pain and suffering. She also seeks compensation for medical expenses incurred as a result of her injuries and any future medical costs she may face. Additionally, Rowan requests compensation for lost earnings due to her inability to work following the incident.

Representing Kristine Rowan is Alexandra A. Hamilton from The Hamilton Law Firm based in San Francisco. The case has been assigned Case No.: CGC-24-620736 in front of judges at the Superior Court of California in San Francisco County.
