Anthony Alvarado, the plaintiff, lodged the complaint against DH Pace and Raintree Realty, LLC in the Superior Court of California, County of San Francisco on January 7, 2025. The case centers around allegations of negligence and product liability after Alvarado suffered debilitating injuries due to a malfunctioning gate at his workplace.
The complaint outlines that on August 21, 2024, Anthony Alvarado was performing his duties as an employee at Costco in San Francisco when tragedy struck. While closing a gate manufactured by DH Pace and situated on property owned by Raintree Realty, the gate unexpectedly rolled off its track and collapsed. This catastrophic failure resulted in Alvarado being struck by the falling structure, causing him to suffer a broken leg and serious foot injury. His co-workers initially struggled to get help due to being locked outside but eventually managed to alert management who facilitated his transport to San Francisco General Hospital.
Alvarado's legal team from Arns Davis Law argues that both defendants failed in their respective duties—Raintree Realty for not maintaining safe premises and DH Pace for providing a defectively designed and manufactured product. The complaint asserts that Raintree Realty neglected its responsibility to ensure the safety of its premises despite being aware of potential hazards associated with the gates. Similarly, it accuses DH Pace of negligence in designing excessively heavy gates prone to dislodging from their tracks, thus posing significant risks to users.
The lawsuit details several causes of action including negligence against Raintree Realty and multiple claims against DH Pace for design defects, manufacturing defects, and product negligence. It emphasizes that these breaches directly led to Alvarado's severe injuries which necessitated surgery and ongoing physical therapy.
