David Tyrone Love has filed a lawsuit against the City and County of San Francisco, alleging negligence and premises liability after suffering serious injuries from a fall into an unsecured manhole. The complaint was filed on January 8, 2025, in the Superior Court of California, County of San Francisco. Love accuses the City and County of failing to maintain safe conditions at the intersection where the incident occurred.
According to the complaint, David Tyrone Love was injured on March 15, 2024, while lawfully present at the intersection of Natoma Street and Russ Street in San Francisco. The plaintiff claims he fell into a defective and dangerous storm drain or manhole that was not properly secured or covered. As a result, Love sustained significant physical injuries requiring medical treatment and experienced pain, suffering, and loss of earnings. The lawsuit argues that the City and County had a duty to ensure their premises were safe for public use but failed to do so.
The complaint further alleges that both entities knew or should have known about the hazardous condition but neglected to repair it or provide adequate warnings. It asserts that this failure directly led to Love's injuries. "Defendants breached their duty of care by negligently managing and maintaining the premises," states the filing. The plaintiff seeks compensation for medical expenses, lost wages, future earning capacity losses, and general damages for pain and suffering.
Love's legal team is demanding a jury trial to resolve these issues. They argue that under various sections of California's Government Code—specifically sections 815.2(a), 815.4, 815.6, 820(a), and 835—the defendants are liable for creating an unsafe environment that posed unreasonable risks to individuals like Love.
