Juan Carlos Garcia has filed a class action lawsuit against several companies, alleging significant violations of California labor laws. The complaint was filed on April 29, 2025, in the Superior Court of California, County of Santa Clara, against Carroll’s LLC doing business as National Tire Wholesale (NTW), TBC Corporation, TBC Brands LLC, and TBC – Tire and Battery Corporation. Garcia claims these entities failed to pay employees for all hours worked, including minimum wage and overtime, neglected to provide required meal and rest periods, and did not furnish accurate wage statements.
The case outlines multiple grievances under California's labor codes. Garcia accuses the defendants of not compensating employees for all hours worked at both standard and overtime rates. He also alleges that the companies did not provide legally mandated meal breaks or rest periods. According to the complaint, "Defendants have willfully failed to pay some employees all minimum wage, straight time wages, overtime wages," which violates several sections of the California Labor Code. Furthermore, Garcia asserts that upon termination of employment, final wages were not paid promptly as required by law.
Garcia is seeking a range of remedies from the court. These include unpaid wages with interest, statutory penalties for each violation under relevant labor codes, liquidated damages where applicable, and reimbursement for any necessary expenditures incurred by employees in their job roles. Additionally, he requests that the court grant injunctive relief to prevent future violations by these companies and demands a jury trial for these allegations.
