A former top-performing truck driver has filed a lawsuit against multiple companies and individuals, alleging workplace discrimination, retaliation, and wrongful termination following a work-related injury. Kenny An filed the complaint in the Superior Court of California, County of San Francisco on January 17, 2025, against Corten Industries Inc., All Bay Trucking, Bizon Group Inc., and several individuals.
Kenny An's legal battle centers around allegations of disability discrimination after he sustained a back injury in August 2022 due to defective truck equipment. An claims that upon returning from workers' compensation leave, he faced systematic retaliation from his employers. This included being assigned older trucks with mechanical issues, reduced income, discriminatory comments, and ultimately termination in January 2023. "Defendants systematically retaliated against him," the complaint states. The defendants are accused of violating various state and federal laws including the California Fair Employment and Housing Act (FEHA), California Family Rights Act (CFRA), and several provisions of the California Labor Code.
An's lawsuit lists numerous grievances such as failure to accommodate his physical disability, failure to engage in an interactive process for accommodations, FEHA retaliation, whistleblower retaliation under California Labor Code §1102.5(b), wrongful termination in violation of public policy, failure to prevent discrimination and retaliation, intentional infliction of emotional distress, negligent infliction of emotional distress, wage theft violations including failure to pay meal and rest period compensation as per Cal. Lab. Code §226.7 among others.
The plaintiff seeks compensatory damages exceeding $138,000 for lost wages and benefits due to alleged unlawful conduct by the defendants. Additionally, An demands punitive damages for emotional distress caused by what he describes as "malicious" actions by his employers who allegedly manipulated corporate structures to avoid liability.
