A California resident has filed a lawsuit against a construction company and its employee, alleging negligence that resulted in a car accident causing significant injuries. Igor Kotlyar initiated the complaint on January 24, 2025, in the Superior Court of California, County of San Francisco, naming Javier Castillo and Trinet Construction, Inc. as defendants.
The lawsuit arises from an incident that occurred on January 27, 2023. According to the complaint, Kotlyar was driving his 2016 Nissan Rogue on Oak Street in San Francisco when it was violently struck by a 2021 Dodge Ram operated by Castillo. The plaintiff claims that Castillo was acting within the scope of his employment with Trinet Construction at the time of the accident. The complaint further alleges that both Castillo and Trinet Construction failed to exercise due care while operating their vehicle, thereby breaching their duty to ensure safe travel on public roads.
Kotlyar accuses Castillo and Trinet Construction of negligence per se for violating California Vehicle Code sections 21703 and 22350. These sections mandate maintaining a reasonable distance between vehicles and adhering to safe speed limits. The plaintiff asserts that the defendants' failure to comply with these laws directly led to the collision and his subsequent injuries.
The injuries sustained by Kotlyar include damage to his knee, back, and neck, resulting in ongoing physical pain and suffering. The complaint also mentions potential permanent disability due to these injuries. Furthermore, Kotlyar has incurred medical expenses for treatment and anticipates future medical costs as well as lost wages due to being unable to work.
In addition to negligence claims against all defendants, Kotlyar accuses Trinet Construction of negligent entrustment. He argues that the company knowingly allowed an incompetent driver—Castillo—to operate their vehicle despite being aware of his reckless driving tendencies.
Kotlyar seeks various forms of relief from the court: general damages for pain and suffering; compensation for medical expenses; reimbursement for lost earnings; interest as permitted by law; costs associated with filing the suit; and any additional relief deemed appropriate by the court.
