Jane Doe has filed a lawsuit against Brock Aguirre, accusing him of sexual battery and other serious offenses. The complaint was submitted on January 23, 2025, in the Superior Court of California, County of San Francisco. Jane Doe alleges that Brock Aguirre committed multiple acts of violence against her during their brief relationship as college students.

The plaintiff, identified as Jane Doe to protect her privacy, recounts harrowing experiences from the fall of 2016 when she was a student at the Academy of Art University in San Francisco. She claims that Aguirre forcibly raped and sexually assaulted her after they had been dating for only a few weeks. According to the complaint, one incident occurred when Aguirre visited Doe's dorm room unannounced and proceeded to lock the door behind him before violently assaulting her despite her objections and pleas for him to stop. "Over Plaintiff's cries and pleas for Defendant Aguirre to stop," the document states, "Defendant Aguirre proceeded to violently rape Plaintiff for over an hour."

Doe asserts that these traumatic events led her to drop out of school due to fear and proximity to her alleged attacker. She also experienced severe emotional distress, requiring therapy and medication. The lawsuit details how Aguirre continued his harassment by sending unsolicited text messages over a year later, attempting to manipulate Doe into denying the rape allegations.

The complaint accuses Brock Aguirre of violating several California Civil Codes related to sexual battery (Civ. Code § 1708.5), gender violence (Civ. Code § 52.4), and interference with civil rights (Civ. Code § 52.1). It also cites violations under the Ralphs Civil Rights Act (Civ. Code § 51.7) among others like assault, battery, intentional infliction of emotional distress, and false imprisonment.

In seeking justice through this legal action, Jane Doe requests general and special damages according to proof at trial, punitive damages for the malicious nature of Aguirre's actions, statutory civil penalties under relevant civil codes, attorney fees as allowed by law, costs incurred during litigation, and any further relief deemed appropriate by the court.

Representing Jane Doe is attorney Mark T. Kearney from MK Smith APC law firm based in Irvine, California. The case is presided over by Judge Sahar Enayati under Case No: 621713 at the Civic Center Courthouse in San Francisco.
