The complaint was lodged by Alaska National Insurance Company in the Superior Court of California, County of Santa Clara, on February 18, 2025, targeting Ulysses Vasquez as the defendant.
The case revolves around an incident that occurred on February 25, 2023, when George Kevin Fajardo-Torres and Juan Munguia Sanchez were injured while performing their duties for Bay Area Traffic Solutions, Inc., which is insured by Alaska National Insurance Company. The employees were managing traffic on State Route 17 when Vasquez allegedly lost control of his vehicle and caused an accident. The insurance company claims that Vasquez's negligence was a substantial factor in causing the injuries sustained by their insured employees. According to the complaint, "As a proximate result of the injuries suffered by Employees... ALASKA has paid workers’ compensation benefits and incurred other recoverable expenditures."
The plaintiff is seeking various forms of relief from the court. They are asking for general and special damages sustained by the employees due to the accident. Additionally, they seek reimbursement for workers' compensation benefits already paid and those expected to be paid in the future. The insurance company also demands compensation for any additional payments made on behalf of the employees until judgment satisfaction is achieved, as per Labor Code §3857. Furthermore, they request all other recoverable expenditures under Labor Code §3862 and aim to cover costs of suit along with prejudgment interest as allowed by law.
