Porsche Faces Lawsuit Over Alleged Breach Of Warranty By San Francisco Resident

A San Francisco resident has taken legal action against a prominent automobile manufacturer and dealership, alleging multiple breaches of warranty and statutory violations. On February 24, 2025, Deniz Kahramaner filed a complaint in the Superior Court of California, County of San Francisco, against Porsche Cars North America, Inc., Indigo PSF Motorcars, LLC doing business as Porsche San Francisco, and unnamed defendants.

Deniz Kahramaner claims that after purchasing a 2023 Porsche Macan on April 17, 2024, from an authorized dealership with a certified pre-owned express limited warranty issued by Porsche Cars North America, the vehicle developed several defects. These defects reportedly include issues with the airbag system, electrical components, steering column switch malfunctions, and excessive time out of service. Kahramaner argues that these problems significantly impair the vehicle's use, value, or safety. The plaintiff contends that these issues constitute a breach of both implied warranties of merchantability and fitness under California's Song-Beverly Consumer Warranty Act.

The complaint further alleges that despite multiple repair attempts during the warranty period by Porsche's representatives in California, the vehicle was not repaired to conform to applicable express warranties. As such, Kahramaner asserts that Porsche failed to fulfill its obligations under Civil Code sections 1793.2 and 1794 by not replacing or making restitution for the defective vehicle after a reasonable number of repair attempts. Furthermore, it is claimed that Porsche did not maintain adequate service literature or replacement parts for necessary repairs within the warranty period.

Kahramaner seeks various forms of relief from the court including general damages for breach of contract and statutory violations; rescission of the purchase contract with restitution; diminution in value; incidental and consequential damages; civil penalties amounting to twice the actual damages due to willful non-compliance by Porsche; pre-judgment interest; reasonable attorney fees; and any other relief deemed appropriate by the court.
