In a gripping legal battle, two former employees have taken a stand against their previous employer, alleging severe violations of labor laws and discrimination. Muhammad Umer and Dejon Andrade filed a complaint on March 5, 2025, in the Superior Court of California, County of San Francisco, targeting Premier International Group Inc., Wyndham Garden San Jose Airport, Wyndham Garden San Jose Silicon Valley, Wyndham Vacation Resorts Inc., Wyndham Hotel Group Inc., and an individual named Mira Shingal. The plaintiffs claim they were subjected to numerous labor law violations and discriminatory practices during their employment.
Muhammad Umer and Dejon Andrade allege that they faced multiple labor code violations during their tenure with the defendants. According to the complaint, both individuals were hired by Mira Shingal at different times—Umer in January 2023 as a security guard despite applying for a front desk position, and Andrade in November 2022 as a front desk employee. They worked primarily at two hotel locations owned by the defendants in San Jose. The plaintiffs accuse the defendants of failing to provide rest and meal periods as mandated by California Labor Code §§ 226.7 & 1198. Furthermore, they assert that they were not paid minimum wages or overtime for hours worked beyond regular shifts, violating Labor Code §§ 510 & 1194 & 1197.1.
The case took a dramatic turn when Umer was brutally attacked by hotel patrons while on duty on March 6, 2023. Despite being severely injured and fearing for his life, Umer managed to escape and sought help from Andrade who called the police. Following this incident, Andrade was instructed by Shingal to clean up the crime scene instead of addressing safety concerns. Subsequently, both plaintiffs were terminated after reporting the incident to authorities—a move they claim was retaliatory.
The lawsuit further alleges that the defendants engaged in disability discrimination against Umer following his request for accommodation due to emotional distress from the attack. The complaint outlines several causes of action including failure to engage in an interactive process for reasonable accommodations under FEHA (Fair Employment and Housing Act), retaliation under Labor Code §98.6 and §1102.5 for reporting unsafe working conditions, wrongful termination in violation of public policy, among others.
Plaintiffs are seeking compensatory damages for lost wages and benefits along with punitive damages due to alleged malice by the defendants’ actions which included deceitful conduct aimed at depriving them of their rights. They also demand statutory penalties for unpaid wages alongside attorney fees as per Government Code §12965(b).
