A former employee is taking legal action against a California-based corporation, alleging wrongful termination and discrimination due to her disability. Maria Fernanda Chavez Calix filed a complaint on March 24, 2025, in the Superior Court of California, County of San Francisco, against Andy’s BP Inc., accusing them of violating multiple provisions under the Fair Employment and Housing Act (FEHA).
The lawsuit outlines several allegations against Andy's BP Inc., including wrongful termination in violation of public policy, discrimination based on disability, retaliation for requesting accommodation, failure to provide reasonable accommodation, failure to engage in a good faith interactive process, and failure to take reasonable steps to prevent discrimination. According to the complaint, Chavez Calix was employed as an attendant at one of Andy's gas stations in San Francisco from September 2023. Her troubles began when she fell ill at work on February 20, 2024. Despite notifying her manager about her condition and subsequent emergency surgery for appendicitis on February 24, she received no response. When she reached out again on March 3 to inform her manager that she was ready to return to work post-recovery, she was informed that her employment had been terminated.
Chavez Calix argues that her temporary disability and request for accommodation were substantial motivating factors behind her termination. The complaint states that Andy’s BP Inc.'s actions were in direct violation of California Government Code sections concerning employment discrimination based on physical or mental disabilities. "It is against the public policy of the State of California for an employer to discriminate against an employee based on the employee’s disability," asserts the complaint.
The plaintiff seeks various forms of relief from the court. She requests general and special damages according to proof presented during trial, compensation for loss of earnings and prejudgment interest. Additionally, Chavez Calix seeks declarative and injunctive relief alongside punitive damages due to what she describes as malicious conduct by Andy's BP Inc. The plaintiff also demands attorney fees and costs associated with bringing this suit forward.
