A former employee has filed a lawsuit against a major aviation company, alleging discrimination, retaliation, and wrongful termination. Nicholos Albert Allen initiated the complaint on April 1, 2025, in the Superior Court of California, County of San Francisco, targeting ABM Aviation Inc., a Georgia-based corporation.
The case revolves around allegations that ABM Aviation failed to accommodate Allen's disability following a work-related injury. According to the complaint, Allen was employed as a truck driver by ABM Aviation at San Francisco International Airport starting June 15, 2022. On November 14, 2023, he suffered a shoulder injury while unloading bags but continued working until the pain became unbearable. After seeking medical treatment and being prescribed modified duties due to his injuries, Allen claims that ABM Aviation did not accommodate his needs and instead retaliated against him for taking medical leave.
Allen alleges that on April 12, 2024, he qualified for a transitional work replacement program but was terminated shortly after reporting for duty on April 18. He contends that his termination was motivated by his disability or perceived disability and requests for accommodation. The lawsuit accuses ABM Aviation of violating several sections of the California Government Code §§12940 et seq., which prohibit discrimination based on disability and mandate reasonable accommodations.
The plaintiff is seeking compensatory damages exceeding $25,000 for lost wages and benefits, emotional distress, and punitive damages to deter future misconduct by the defendants. Additionally, Allen demands injunctive relief to prevent further discriminatory practices by ABM Aviation and seeks reinstatement to his former position.
