California Couple Accuses Driver of Negligence Following Highway Collision

A couple from California has filed a lawsuit seeking justice after a severe car accident allegedly caused by another driver. On April 29, 2025, Dmitrijs Jermoljevs and Tamila Hetagurova filed a complaint in the Superior Court of California, County of San Francisco, against Richard Duong and unidentified defendants referred to as DOES 1-10.

The plaintiffs, represented by attorney Alan Mikshansky, claim that on May 3, 2023, Dmitrijs Jermoljevs was driving a 2016 Silver Benz on US-101 northbound in San Francisco when their vehicle was rear-ended by a Honda operated by Richard Duong. The complaint accuses Duong of negligence for failing to exercise due care while driving, leading to the collision that resulted in severe physical injuries and emotional distress for Jermoljevs. The plaintiffs allege that Duong violated California Vehicle Code § 22350 by not taking reasonable action to prevent foreseeable harm.

According to the complaint, the accident has caused significant damages to the plaintiffs, including medical expenses for past and future treatment, lost earnings and earning capacity, and other related costs. Additionally, they have been deprived of their rights of consortium—encompassing love, companionship, comfort, care, assistance, protection, affection, society moral support—and are expected to continue facing these losses. As such, they seek general and special damages exceeding $35,000 along with interest and legal costs.

The case is presided over by Judge Marivic Viray under Case No. CGC-25-624861. Attorney Alan Mikshansky represents the plaintiffs in this matter.
