SAN FRANCISCO – A corporation based in San Diego is suing Nest Labs Inc. over allegations of patent infringement.

e.Digital Corp. filed a lawsuit Jan. 22 in the U.S. District Court for the Northern District of California District Court, San Francisco Division against the Palo Alto-based corporation.

According to the claim, U.S. Patent No. 9,002,331 and 9,178,983, titled System and Method for Managing Mobile Communications, were issued to Patrick Nunally and e.Digital is the assignee and owner of the entire right, title and interest of both. The plaintiff alleges that Nest’s remote monitoring systems, including remote sensors, servers and mobile applications sold as Nest-branded products and services, infringe on these patents.

e.Digital is seeking a jury trial to prove the alleged infringements of the patents-in-suit. The plaintiff is also seeking compensation for all damages and pre- and post-judgment interest on its damages. Gabriel G. Hedrick, Anton N. Handal and Lauren G. Kane of Handel and Associates in San Diego will represent e.Digital.
