Bay Area Credit Service LLC sued over alleged violation of TCPA

SAN FRANCISCO – An individual has filed a class-action lawsuit against a collection company over claims it contacted him on his cellphone without his consent.

Gary Geisert filed a complaint on behalf of all others similarly situated on Feb. 8 in the U.S. District Court Northern District of California against Bay Area Credit Service LLC alleging that the collection company willfully violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he received a call from the defendant in an attempt to collect an outstanding debt using an automatic telephone dialing system. He claims was charged for this call and informed the defendant to not call him but despite this, defendant continued to do so.

The plaintiff seeks for the class $500 per every alleged negligent violation of the TCPA and $1,500 for every alleged knowing or willful violation of the TCPA, plus any other relief the court deems just and proper.
