SAN FRANCISCO – An insurance company is suing a California transportation company after it allegedly damaged the cargo it was hired to move.
Allianz Global Risks U.S. Insurance Co. filed a complaint on Feb. 10 in the U.S. District Court for the Northern District of California against Jared & Grandpa Trucking Inc.; and Does 1 through 25, citing violation of the Carmack Amendment.
According to the complaint, the plaintiff alleges that in November 2013, Allianz Global Risks U.S. Insurance Co. sought to transport its property from Wyoming to California by acquiring the services of the defendant. The suit states that on Nov. 21, 2013, the defendant's truck overturned in Nevada, damaging the property. The plaintiff holds the defendants responsible because they allegedly failed to deliver the cargo in exact condition it went in and refused to return the property and/or provide full reimbursement.
The plaintiff seeks the following: compensatory damages of $139,000, prejudgment interest, costs of the suit and any other relief the court deems just and proper. It is represented by Ashley E. Bauerle of Cozen O' Connor in San Diego.
