Prudential Insurance Co. of America sued over allegations of violating ERISA

SAN FRANCISCO – A former sales representative for Google is suing an insurance company alleging that it denied him disability benefits.

David Ray filed a complaint on Feb. 13 in the U.S. District Court for the Northern District of California against Prudential Insurance Co. of America, citing violation of the Employee Retirement Income Security Act of 1974.

According to the complaint, the plaintiff alleges that he filed a claim for disability benefits in September 2013 under the Google Welfare Benefit Plan, of which the defendant was a claim administrator and fiduciary for. He alleges that the defendant allegedly denied benefits of the plan to plaintiff in June 2014, despite having sufficient supporting documents showing that he is indeed disabled and meets the requirements according to the terms of the plan.

The plaintiff seeks the following: an order that the defendant pay disability benefits owed to him, interests, and any other relief the court deems just and proper. He is represented by Scott Kalkin of Roboostoff & Kalkin in San Francisco.
