Provident Life and Accident Insurance Co. over alleged denial of benefits

SAN FRANCISCO – A Pennsylvania woman is suing an insurance company doing business in California over allegations that it wrongfully denied her claim for long-term disability benefits.

Nancy Van Orlando filed a complaint on Feb. 19 in the U.S. District Court for the Northern District of California against Provident Life and Accident Insurance Co., citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she was found to be disabled in June 2012 by her personal physicians because of a head injury and associated symptoms that impeded her from returning to full-time work. She applied for a long-term disability plan from the defendant but was eventually denied, the suit states. The plaintiff holds Provident Life and Accident Insurance Co. responsible because its decision of not providing her benefits was allegedly based on a medical review made by the defendant alleging that her injury and symptoms were not severe and that she could go back to work.

The plaintiff seeks the following: compensation for all damages including prejudgment interest on all back benefits, legal fees and any other relief this court deems just and proper. She is represented by P. Randall Noah of Law Offices of P. Randall Noah in Orinda.
