SACRAMENTO – A Fresno woman is suing two Florida companies over allegations that they contacted her without her consent.
Kim Sneed filed a class-action lawsuit on Feb. 23, in the U.S. District Court for the Eastern District of California against Life 1 Medical LLC and The Pitter Group LLC, citing violation of the Telephone Consumer Protection Act
According to the complaint, the plaintiff alleges that on Feb. 2, she received a call on her cellular telephone from the defendants using an autodialer or pre-recorded voice without prior consent. The plaintiff alleges that she did not express any consent to the defendant allowing them to call, which is in violation of the TCPA.
The plaintiff seeks the following: injunctive relief prohibiting such actions by the defendant, treble damages of up to $1,500 and statutory damages of up to $500 per call that allegedly violated the TCPA, and any further relief the court deems just and proper.
