Minor, guardian sues health care providers over alleged medical negligence

SACRAMENTO – A minor and his guardian are suing the federal government and doctors, alleging that the defendants wrongfully neglected their duties by providing an inaccurate diagnosis to his condition.

Skylar Martin, through his guardian Timothy Martin, filed a complaint on Feb. 24 in the U.S. District Court for the Eastern District of California against the United States of America; Dr. Christopher Louisell; Morgan Gaura, P.A.; Mercy Medical Center, doing business as Dignity Health; and Does 1 through 100, citing medical negligence.

According to the complaint, the plaintiffs allege that Skylar Martin suffered severe injuries to his body and nervous system while under the care of the defendants in 2013. The plaintiffs hold the defendants responsible because they allegedly failed to properly diagnose plaintiff's condition, meningitis, and provide medical care.

The plaintiffs seek the following: compensation for all damages, past and future medical expenses, interest, legal fees and any other relief the court deems just and proper. They are represented by Steven H. Schultz of Law Office of Steven H. Schultz in Sacramento.
