Hubzone Corp. sued over allegedly unpaid balance

SACRAMENTO – An electrical company is suing a California contractor for an allegedly unpaid amount for supplies needed for a government project.

The United States of America, for the use and benefit of Rexel Inc., doing business as Platt Electric Supply, filed a complaint on Feb. 25 in the U.S. District Court Eastern District of California, Sacramento Division against Hubzone Corp. and Doe 1, citing a complaint to recover on Miller Act bond.

According to the complaint, the plaintiff alleges that on July 24, 2015, it sent a notice of bond claim to the defendants for the remaining unpaid supply costs furnished to the contractor for the Mare Island VA Outpatient Clinic. The plaintiff holds the defendants responsible because they allegedly failed to pay total contract price of $61,490.85, including interest, within the allowable time agreed upon by both parties.

The plaintiff seeks the following: payment of the above balance, legal fees and any other relief the court deems just and proper. It is represented by Edmond R. Pietraczyk of Law Offices of Edmond R. Pietraczyk in San Ramon.
