Woman sues Fingerhut over alleged violation of TCPA

SACRAMENTO – A Sacramento woman is suing a Minnesota company over allegations that it repeatedly called her using an automated voice recording.

Lynette O'Neill filed a complaint on Feb. 25 in the U.S. District Court for the Eastern District of California against Bluestem Brands Inc., doing business as Fingerhut, citing violation the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that she was called using a pre-recorded voice multiple times in an attempt to collect a debt beginning in November 2015. The plaintiff holds Bluestem Brands Inc. responsible because the defendant allegedly ignored plaintiff's request and kept calling despite of asking them to stop calling her.

The plaintiff seeks the following: statutory damages of $500 and treble damages of $1,500 per allegedly violating call, injunctive relief and any other relief the court deems just and proper. She is represented by Amy Lynn Bennecoff Ginsburg of Kimmel & Silverman PC in Ambler, Pennsylvania.
