Audible Magic Corp. files suit over alleged breach of contract

SAN FRANCISCO – A California business is accusing a Texas corporation of unlawfully using its software without authorization.

Audible Magic Corp. filed a complaint on Feb. 26 in the U.S. District Court for the Northern District of California against BCD Music Group Inc.; Deep Distribution Worldwide Inc.; Christian IP; Shila Mitra, also known as Sushila Blakeslee; and Janet Jordan; citing breach of contract and copyright infringement.

According to the complaint, the plaintiff alleges it suffered damages due to its Replicheck software being used and distributed without its consent. The plaintiff holds the defendants responsible because they allegedly made unauthorized copies of plaintiff's software as well as failed to return or destroy copies of the software after their contracts had expired with the plaintiff.

The plaintiff seeks the following: compensation for all damages, including permanent injunction requiring the defendant to return or destroy all copies of plaintiff's software, legal fees and any other relief as the court deems just and proper.
