R & T Heating and Sheet Metal Co. accused of not paying contributions

Breach contract

SAN FRANCISCO – A California company is being accused of breaching a bargaining agreement.

Sheet Metal Workers Local 104 Health Care Trust and its board of trustees; Sheet Metal Workers Pension Trust of Northern California and its board of trustees; Sheet Metal Workers Local 104 Supplemental Pension Fund and its board of trustees; Sheet Metal Workers Local 104 Vacation - Holiday Savings Fund and its board of trustees; Monterey/Santa Cruz and San Benito Counties Sheet Metal Local 104 Training Fund and its board of trustees; Rick Werner; and Sheet Metal Workers International Association Local Union 104 filed a complaint on Feb. 29 in the U.S. District Court for the Northern District of California against R & T Heating and Sheet Metal Co., doing business as Comfort Control, citing breach of bargaining agreement.

According to the complaint, the plaintiffs allege that between October 2015 and December 2015, they did not receive any contributions in accordance to the bargaining agreement they have with the defendant. The plaintiff holds R & T Heating and Sheet Metal Co. responsible because the defendant allegedly refused to pay contributions, which left damages and interests to be incurred by plaintiff.

The plaintiffs seek the following: compensation for all damages including interests, unpaid contributions, legal fees and any other relief the court deems just and proper. They are represented by Michele R. Stafford and Timothy A. Froehle of Saltzman & Johnson Law Corp. in San Francisco.
