SAN FRANCISCO – A wireless provider is suing a Castro Valley man alleging that he illegally acquired mobile devices using fraudulent acts and sold them for a profit.

Sprint Solutions Inc. and Sprint Communications Co. LP filed a complaint on March 2 in the U.S. District Court for the Northern District of California, San Francisco Division against Thomas Brewer, citing breach of contract, unfair competition, civil conspiracy, common law fraud and other counts.

According to the complaint, the plaintiffs allege that they suffered damages and will continue to lose business due to fraudulent acts involving the sale and acquisition of their mobile devices. The plaintiffs hold Brewer responsible because the defendant allegedly used "credit mules" and "runners" in order to acquire mobile phones from the plaintiffs and sell them to other customers for his own profit without subscriptions to the plaintiffs' services.

The plaintiffs seek the following: compensation for all damages, lost profits, permanent injunction to prevent the defendant from engaging unlawful practices in the future, legal fees and any other relief as this court deems just and proper. They are represented by Mark A. Neubauer and Valerie D. Escalante of Carlton Fields Jorden Burt LLP in Los Angeles.
