Granite Rock Co. accused of violating Clean Water Act

OAKLAND – A nonprofit is suing a Redwood City company over allegations it is discharging polluted storm water from its facility into the San Francisco Bay.

San Francisco Baykeeper filed a complaint on March 3 in the U.S. District Court for the Northern District of California, Oakland Division against Granite Rock Co., citing violation of the Clean Water Act.

According to the complaint, the plaintiff alleges that its members sustained damages due to the continued pollution of water by the defendant as its members use the bay for educational, scientific and other purposes. The plaintiff holds Granite Rock Co. responsible because the defendant allegedly has not achieved compliance with the industrial storm water permit and storm water pollution prevention plan.

The plaintiff seeks the following: enjoin the defendant from discharging pollutants from its facility to discharge points, restore all damaged waters, legal fees and any other relief as the court deems just and proper.
