SAN FRANCISCO – An Alameda County plumbing company has filed a suit against a Houston-based energy company and a telemarketing company, alleging they illegally contacted it.
Abante Rooter and Plumbing Inc. filed a class-action lawsuit on March 9 in the U.S. District Court for the Northern District of California against Direct Energy LP and Lead Genesis Inc., citing violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that on Oct. 1, 2015, its owner Fred Heidarpour received a call on his cellular telephone from the defendants that was allegedly placed using an automatic telephone dialing system. The plaintiff did not provide any consent for these calls and had to pay for the calls made to Heidarpour's mobile phone, the suit states.
The plaintiff seeks the following: statutory damages, permanent injunction against the defendants from doing such actions in the future, all legal fees and any other relief as this court deems just and proper.
