Man files suit alleging Viagra caused melanoma

SAN FRANCISCO – A Kentucky man is suing a pharmaceutical company over allegations it wrongfully failed to disclose potential side effects of its product to consumers.

Michael Smith filed a complaint on March 10 in the U.S. District Court for the Northern District of California against Pfizer Inc. citing alleged breach of implied warranty, fraud and deceit, negligent misrepresentation and other counts.

According to the complaint, the plaintiff alleges that he sustained physical injuries as a result of taking Viagra. The suit states he developed malignant melanoma as a result of taking the drug. The plaintiff holds Pfizer Inc. responsible because the defendant allegedly had knowledge of the side effect but sold and distributed the drug to consumers without disclosing any potential side effects it may cause.

The plaintiff seeks the following: compensation for all damages, legal fees and any other relief as this court deems just and proper. He is represented by Rachel B. Abrams and Meghan McCormick of Levin Simes LLP in San Francisco and Ernest Cory, Kristian W. Rasmussen and Lauren S. Miller of Cory Watson PC in Birmingham, Alabama.
