TV manufacturers accused of invasion of privacy

SAN FRANCISCO – A Wisconsin man has filed a suit against two California companies alleging their televisions invade on consumers' privacy.

Daniel Von Haden filed a class-action lawsuit on March 11 in the U.S. District Court for the Northern District of California, San Francisco Division against Vizio Inc. and Cognitive Media Networks Inc., citing violation of the Video Privacy Protection Act, the Electronic Communications Privacy Act and other counts.

According to the complaint, the plaintiff alleges that the defendants include software on their Smart TVs to collect user data and information without disclosing the installation of the software to the consumers. He alleges that the data is later sold to third-parties for a profit.

The plaintiff seeks the following: compensation for all damages; injunctive, punitive and equitable relief; interest; all legal fees and any other relief as the court deems just and proper. He is represented by Jason S. Kilene, David A. Goodwin and Joseph C. Bourne of Gustafson Gluek PLLC in Minneapolis, Minnesota.
