LOS ANGELES – A Laguna Niguel man is suing a car manufacturer over allegations it violated U.S. environmental law by putting a "defeat device" in its cars that would temporarily reduce emissions in order to pass inspection.
Seyed Sadeghi filed a complaint on Feb. 8 in the U.S. District Court for the Central District of California, Southern Division against Volkswagen Aktiengesellschaft and Volkswagen Group of America Inc., citing alleged breach of implied warranty, breach of contract, fraud and negligence.
According to the complaint, the plaintiff alleges that he purchased a 2011 diesel Volkswagen Golf with a defeat device. The plaintiff holds Volkswagen Aktiengesellschaft and Volkswagen Group of America Inc. responsible because the defendants allegedly manufactured vehicles with the devices despite of the environmental laws in place.
The plaintiff seeks the following: compensation for all damages, restitution, legal fees and any other relief as the court deems just and proper. He is represented by Stephen G. Recordon of Recordon & Recordon in San Diego.
