Former Bank of America employee files suit regarding pension

SAN FRANCISCO – A Santa Cruz County man alleges that his former employer refuses to provide him with information about his pension.

Michael L. Rodrigues filed a complaint on March 22 in the U.S. District Court for the Northern District of California against Bank of America NA, Bank of America Pension Plan and Does 1-50, citing violation of the Employee Income Retirement Security Act.

According to the complaint, the plaintiff alleges that he worked for the defendant from 1982 to 1988 and was provided with a pension plan. He alleges he contacted the defendant in 2015 to inquire about the balances of the pension, but the defendant had no records of him working there. The suit states that the defendants have refused to produce a summary of the plan.

The plaintiff seeks the following: payment of full pension, for the defendant to produce all documentation regarding the pension, all legal fees and any other relief as the court deems just and proper. He is represented by Wallace C. Doolittle and James P. Downs of Law Offices of Wallace C. Doolittle in Hayward.
