Mother files suit against insurance company seeking benefits for son's treatment

SAN FRANCISCO – A Santa Clara County woman and her son are suing an insurance company alleging it wrongfully underscored the son's condition and denied plan benefits.

Cheryl N. and Tristan W. filed a complaint on March 22 in the U.S. District Court for the Northern District of California against Aetna life Insurance Co. citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that Aetna life Insurance Co. denied paying for part of Tristan's mental health treatment that he received in 2012 to 2013, despite appeals. The suit states the total cost of the unpaid treatment is $123,200.

The plaintiffs seek the following: unpaid expenses plus interest, all legal fees and any other relief as the court deems just and proper. They are represented by David M. Lilienstein of DL Law Group in San Francisco and Brian S. King of Brian S. King PC in Salt Lake City.
